1. PROMOTIONAL PERIOD

The Coates Hire AFL Finals Branch 25% Off and Eddie Betts Signed Merchandise Promotion (Promotions)

Terms and Conditions (Conditions)
The Promotions start on Monday 9 September 2019 and end on Saturday 7 March 2020 at any of Coates Hire participating branches (Promotional Period)

2. ENTRIES

2.1. To be eligible to enter, individuals must hire an Eligible Item of Equipment(s) from a Participating Branch under the Coates Hire Terms of Hire; in one of the following ways: 

1. In-store: visit a Participating Branch, raise a Hire Schedule and present the Coates Hire Discount Voucher (Discount Voucher) to redeem a 25% discount on an Eligible Item of Equipment. Individuals can also submit their Discount Voucher with contact details to be eligible to win signed Eddie Betts merchandise within the Promotional Period.

 
OR
 

1. Phone: call 13 15 52 and raising a Hire Schedule with a Participating Branch followed by presenting a hard-copy Discount Voucher upon collection or delivery of equipment to redeem the offer. Individuals can also submit their Discount Voucher with contact details to be eligible to win signed Eddie Betts merchandise within the Promotional Period.

(“Eligible Hire”)

3. ELIGIBLE ENTRANTS

3.1.  Eligible Entrants are those entrants who:

1. receive written confirmation from Coates Hire that their Terms of Hire have been approved;
2. present a valid hard-copy Discount Voucher;
3. hire an Eligible Item of Equipment as per Annexure A;
4. comply with the Terms of Hire throughout the Promotional Period (including but not limited to payment terms); and
5. submit their Coates Hire Account or contact details on the Discount Voucher (to be eligible to win signed Eddie Betts merchandise);

(Eligible Entrant).

3.2. Eligible Entrants do not include Customers with a current pricing arrangement, other hire companies and original equipment manufacturers  

3.3. The Promoter accepts no responsibility for:

1. Lost Coates Hire Discount Vouchers; and
2. entrants not receiving approval from the Promoter in respect of this Promotion

3.4. This Promotion is not available in conjunction with any other offer or promotion.

3.5. The Eddie Betts Signed Merchandise Promotion is a game of skill and chance plays no part in determining the Winner. Each valid entry will be individually judged by the Promoter according to its merits based on the creativity of the entry specified in clause 4.12.

3.6. Entry into the Promotion is deemed acceptance of these Conditions. 

4. THE OFFER

4.1. The Discount Voucher provides the customer with 25% off Eligible Items of Equipment and entry into the Eddie Betts Signed Merchandise Promotion (Offer).
4.2. Eligible Items of Equipment are set out in Annexure A.
4.3. To redeem the Offer, the Eligible Entrant is required to present a valid hard-copy Discount Voucher to the Promoter. The Promoter will collect the Discount Voucher permanently.
4.4. The Offer will not apply for hires over 90 days.
4.5. For clarity, the Offer cannot be used to offset any claim against the Eligible Entrant in respect of Equipment that has been lost, stolen or damaged while on hire to the Eligible Entrant.
4.6. Each Eligible Entrant may only access the Offer one time during the Promotional Period.
4.7. The Offer cannot be exchanged or redeemed for cash.
4.8. The Offer will not apply to transport or delivery charges.
4.9. The Offer will not apply to labour and installation charges.
4.10. The Offer will not apply to consumables and fuel.
4.11. The Offer will not apply to re-hired equipment.
4.12. All hire periods for any Eligible Hires must commence prior 5:00pm AEST on Saturday, 7 March 2020.

5. EDDIE BETTS SIGNED MERCHANDISE PROMOTION

5.1. Eligible Entrants in the Eddie Betts Signed Merchandise Promotion are those entrants who:

1. submit their Coates Hire Account or contact details on the eligible Discount Voucher; and
2. comply with the Terms of Hire throughout the Promotional Period (including but not limited to payment terms) 

5.2. Betts Eligible Entrants must leave a comment on the Discount Voucher to the request “Tell us in less 
          than 25 words what it takes to be a true AFL legend?”

5.3. Winners will be selected every two months on three different dates during the promotional period until12:00PM AEST on Saturday, 7 March 2020:

1. first winner selected at 12:00PM on Monday, 11 November 2019;
2. second winner selected at 12:00PM on Monday, 20 January 2020; and
3. third winner selected at 12:00PM on Monday, 9 March 2020

5.4. By entering the Promotion, each Betts Eligible Entrant warrants to the Promoter that in
        respect of each of the copyright works contained in their entry:

1. it does not infringe the rights of any third party and all efforts have been taken to avoid any such infringement including by adequately obscuring any copyright works depicted in the entry such as logos or brands;
2. it does not contain any trade marks, except those of the Promoter;
3. they own the copyright in those works and are entitled to submit the works as part of, and for the purposes of, the Promotion; and
4. they are the author of the works.

 
5.5. Each Betts Eligible Entrant consent to any use of their entry pursuant to the Copyright Act 1968 (Cth), including the Promoter’s use of all copyright works comprised in their entry including:

1. without attribution to the entrant;
2. with changes to the work of any kind; and
3. in advertising and any other promotion of the Promoter and its products.

 
5.6. As a condition of entry, each Betts Eligible Entrant must assign to the Promoter all copyright held by the Eligible Entrant in the works.  

5.7. By entering the Promotion, each Betts Eligible Entrant warrants that their entry is not offensive, inappropriate, defamatory, does not infringe the rights of any third party including copyright or trade mark rights, or is not otherwise against the law.
 
5.8. The Promoter may, in its sole discretion, disqualify entries with third-party brands or logos, or any other copyright works or trade marks. 

5.9. The Promoter may, in its sole discretion, take down an entry from any platform, or disqualify an entrant for an entry, that it deems to be offensive, inappropriate, defamatory, that infringes the rights of any third party including copyright or trade mark rights, or is otherwise against the law. 

5.10. Each Betts Eligible Entrant are deemed to be received at the time specified on the time   stamp of the Terms of Hire. The Promoter is not responsible for failure to receive any entry,
whether for any cause beyond its control or otherwise.
 
5.11. All valid entries received during the Promotional Period will be judged by the Promoter at Level 6, 241 O’Riordan Street, Mascot NSW 2015. 

5.12. Each Betts Eligible Entrant that best meets the criteria set out in clause 4.24 during the Promotional Period, as decided by the Promoter (Winner), will be awarded 1 signed Eddie Betts AFL Sherrin football (Prize). 

5.13. After judging, the Winner will be notified promptly by via contact details on the Coates Hire Discount Voucher. 

5.14. The Competition is a game of skill and chance plays no part in determining the Winner. Each valid entry will be individually judged by the Promoter according to its merits based on among other things, creativity, originality, literary merit and suitability and adherence to the guide outlined in clause 4.2.

6. GENERAL

6.1. The Promoter reserves the right to disqualify any entrant that engages in any unlawful or other misconduct calculated to jeopardise the fair and proper conduct of the Promotion. 

6.2. Any attempt, deliberate or otherwise, to undermine the legitimate operation of this Promotion  may be a violation of criminal and civil laws and, should such an attempt be made, whether
successful or not, the entrant agrees to indemnify the Promoter for all losses, damages and
costs suffered by the Promoter as a result of the entrant’s breach of these Conditions.
 
6.3. If this Promotion is not capable of running as planned for any reason beyond the Promoter’s  reasonable control, the Promoter reserves the right, in its sole discretion, to cancel, terminate,
modify or suspend the Promotion and/or, if necessary, to provide an alternative offer or offers
to the same value as an original offer or offers, subject to any written directions made under
applicable State or Territory legislation.
 
6.4. The Promoter, its associated agencies and companies excludes all liability (including negligence) except for any liability that cannot be excluded by law, for any direct or indirect injury, loss and/or damage arising in any way out of the Promotion.

6.5. As a condition of entering this Promotion, an entrant consents to the Promoter using theentrant’s name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period of time without further notification, remuneration or compensation for the purpose of promoting, publicising or marketing the Promotion (including any outcome), and/or promoting any products or services manufactured, distributed and/or supplied by the Promoter.
